An Overview of Using Industrial Design Protection in The Healthcare Sector

Abstract

Design proves to be an instrument in differentiating and adding value in all sectors, and can be protected by industrial design registration, which makes it possible to generate information that allows characterizing system users. The aim of this article is to analyze the use of industrial design protection in the health sector, providing an overview of this use in Brazil and internationally. Methodologically, an exploratory and qualitative perspective was used, using the industrial design databases of the National Institute of Industrial Property (INPI), as well as the World Intellectual Property Organization (WIPO), in order to draw an overview. As conclusions, it was possible to attest to the reduced use of this system by residents, to identify those countries that are most interested in protecting their creations within our market, as well as to identify the largest international users of the industrial design protection system, in Brazil, in health sector.

Graduated in Scenic Arts (Scenography and Clothing) from the School of Fine Arts of the Federal University of Rio de Janeior (UFRJ), 1996. Master in Art History from UFRJ, 2001, Doctor in Visual Arts from UFRJ, 2006, and Post-Doctor in Cultural Studies by the Advanced Program of Contemporary Culture – PACC/UFRJ, 2013. Since 2006, Technologist in Industrial Property at the National Institute of Industrial Property (INPI). Since 2007, permanent professor of the Postgraduate Program in Intellectual Property and Innovation (Professional Master's and Doctorate) at INPI.

Graduated in Architecture and Urbanism from Universidade Santa Úrsula (1986), graduated in Civil Engineering from Universidade Santa Úrsula (1990) and graduated in Business Administration from Universidade Estácio de Sá (2011). Masters in Civil Engineering (1997) and PhD in Civil Engineering both from the Federal University of Rio de Janeiro – UFRJ (2003). Since 2007, she has been a researcher at the National Institute of Industrial Property (INPI). Since 2008, she has been a member of the faculty of the Professional Master's and Doctoral Program in Intellectual Property and Innovation at INPI.

INPI's public servant since 2006, currently, he works as INPI's Industrial Design Examiner since 2017 and Substitute Head of the Division.
Participant in Technical Groups for the improvement of procedures related to the technical examination of industrial designs, such as the implementation of the Ipas system for industrial designs and the revision of the Industrial Design Manual, in addition to groups of studies to facilitate Brazil's accession to the Agreement of The Hague and a member of the Interministerial Industrial Property Group of the Ministry of Economy, to discuss and reformulate the Industrial Property Law.
