Abstract

Recent legislative changes aimed at defining instruments that make it possible to deal quickly with the public health emergency caused by the pandemic of the disease caused by the new coronavirus allow restrictions to several individual fundamental rights. This is qualitative documentary research, based on scientific, opinion and journalistic articles, and legislation. It begins with a brief historical passage through the legislation that restricts freedom and autonomy based on public health concerns, called Non-Pharmaceutical Measures (MNF), and aspects related to the recent COVID-19 pandemic and its mitigation. Then, it performs an analysis of the instruments provided by the Law n. 13.979, of February 6, 2020, in particular quarantine and isolation, as well as of Interministerial Ordinance No. 5, of March 17, 2020, by the Ministries of Justice and Public Security and Health, and Ordinance n. 356 of the Ministry of Health, in light of the Constitution of the Republic of Brazil, ethics and public health.

She is currently a retired professor at the Federal University of Alagoas, having been Vice-coordinator of the Professional Master's PROFNIT - Focal Point UFAL until August 2018. She is a professor of the Master's PRONIT/UFAL coordinating the discipline of Technological Prospecting. She was coordinator of the Center for Technological Innovation and Special Programs at PROPEP/UFAL, coordinating the Institutional Program for Initiation Scholarships in Technological Development and Innovation - PIBITI from 2010 to January 2016. She has experience in the areas of Intellectual Property, Civil Construction and in Electrochemistry, with emphasis on Construction Materials and Components and Corrosion and Durability Tests, working mainly on the following topics: civil construction, construction materials, concrete properties, durability of reinforced concrete structures and building facade pathologies. She was vice-coordinator of FORTEC Regional NE from April 2010 to April 2012 and alternate on the Fiscal Council of ANPROTEC.
