Ethics and laws created by man, ultimately, orient the limits of human action. Considering the current environmental crisis, increases the need to build a bioethics limit that determine the behavior of man on the environment. Furthermore, the Brazilian legislation is silent and obscure to conceptualize environmental damage, so the concept has been supplemented by the doctrine and built from each case by jurisprudence. In this sense, based on doctrinal and jurisprudential research, the present work aims to demonstrate
that the civil responsibility for environmental damage should be interpreted in the context of ecological sustainability, constructed on values coming from the field of ethics, based on sustainable development, in the principles of prevention and precaution, the collective responsibility, as well as the intergenerational solidarity.
