This article aims to analyze the process of implementation of the provisions contained in the judgment handed down by the Inter-American Court of Human Rights concerning to the leading case known as “Gomes Lund and Others versus Brazil” or “Caso Guerrilha do Araguaia”. The problem that is proposed is to verify if the Brazilian State has taken, or how has expressed interest in assuming their responsibilities internationally, fulfilling or excusing the condemnation that suffered before the Inter-American Human Rights System. By assessing the conduct of the Brazilian State, portrayed in literature and in
official documents issued by the Inter-American System for the Protection of
Human Rights, it was concluded, in summary, that Brazil is not satisfactorily
exploited to fulfill the provisions of the Inter-American Court of Human Rights,
which the judgment given in attention to leading case, is pending compliance
in most of it determinations.
