Reflexões sobre a Convenção da UNESCO sobre a Diversidade das Expressões Culturais à luz das noções de cultura e patrimônio

Resumo

A Convenção sobre a Diversidade das Expressões Culturais constitui uma importante ferramenta para a realização dos direitos culturais. Em virtude de suas disposições normativas, a Convenção sobre a Diversidade das Expressões Culturais expressa o valor da diversidade criativa e humana. Contudo, é corrente o entendimento de que o âmbito de aplicação da Convenção está praticamente restrito às expressões culturais contemporâneas e não a todos os aspectos da diversidade cultural. Ocorre que as noções de cultura e de patrimônio cultural, assim como os diversos processos de ampliação dessas noções, podem trazer novos caminhos para a implementação da Convenção e para a concretização dos direitos culturais. Due to its normative formations, the Convention about the Diversity of Cultural Expressions expresses the value of creative and human diversity. However, it is normally understood that the Convention discussion is open only to contemporary cultural expressions and not to all aspects of cultural diversity. The notion of culture and cultural heritage can light up new ways to the implementation of the Convention and to the concretion of the cultural rights.
